Opportunity Partner Terms of Service

What this is

This portal is a private tool operated by Skyyber Entertainment LLC to connect Opportunity Partners with independent DJs.

Opportunity partners do not need an account. By submitting an event request through the Skyyber DJ Portal, you agree to these terms.

Your account

Opportunity partners do not currently have an account or portal login. You submit an event request, and we reply by email to the contact details you provide.

Keep those details accurate. We use them to send you your proposed DJ match, so out-of-date information means a missed match.

Cost

Submitting an event request is free. A booking fee applies only if you confirm a match, as described in the Booking Fee section below.

Opportunity Partner Terms

Skyyber Entertainment ("Skyyber ENT") operates the Skyyber DJ Portal as a facilitator between Opportunity Partners and independent DJs.

Definitions. An "Opportunity Partner" is any event, venue, brand, promoter, or business submitting an event request in search of a DJ through the Skyyber DJ Portal.

Who We Are. Skyyber ENT identifies matches between Opportunity Partners and independent DJs listed on the Skyyber DJ Portal, relays the booking terms agreed upon, and maintains accurate, good-faith roster information. We charge the Opportunity Partner a booking fee for this service, as described below.

Who We Are Not. We are not the DJ's employer, agent, or manager, and we don't take responsibility for the DJs we connect you with once contact information has been released. We are not a party to the performance agreement between you and the DJ, and we do not guarantee outcomes for events we don't produce ourselves. We are, however, a party to the separate booking-fee agreement described below.

How Matching Works. Submitting an event request does not constitute a booking. Skyyber ENT reviews your request and sends you a proposed DJ match and rate via email. You may confirm or decline that match; nothing is booked until you confirm.

Booking Fee. Upon confirming a match, the Opportunity Partner agrees to pay Skyyber ENT a booking fee of 15% of the DJ's stated rate, or $25, whichever is greater. This fee is due at the time of confirmation, before contact information is released, and is separate from and in addition to the DJ's performance rate. Skyyber ENT accepts Cash App, Square, or PayPal (PayPal deducts a small processing fee); payment details are sent upon confirmation.

Payment Structure. The DJ's performance rate is paid directly by the Opportunity Partner to the DJ. Skyyber ENT does not collect, hold, or have any role in that payment. Skyyber ENT's booking fee is a separate transaction, paid directly to Skyyber ENT.

Replacement DJs. If a confirmed DJ becomes unavailable before the event, Skyyber ENT will attempt to provide a replacement DJ from its roster at no additional booking fee.

Cancellations and Refunds. The booking fee is non-refundable once a match is confirmed and paid; it compensates Skyyber ENT for matching and vetting work already completed. The one exception: if the confirmed DJ becomes unavailable and Skyyber ENT is unable to provide a replacement, the booking fee for that booking will be refunded.

Info Release and End of Facilitation. The DJ's direct contact information is released to the Opportunity Partner only after Skyyber ENT's booking fee has been received. Skyyber ENT's role as facilitator ends at that point. From then forward, all performance, conduct, and rate-payment matters are between the Opportunity Partner and the DJ directly. Skyyber ENT is not a party to that performance agreement and does not guarantee event outcomes. Skyyber ENT is, however, a party to the booking-fee agreement above, and that obligation survives regardless of how the event itself goes.

Non-Circumvention. By submitting an event request through the Skyyber DJ Portal, the Opportunity Partner agrees not to directly re-book, for 6 months, any DJ introduced through the portal for the same or a substantially similar event without going through Skyyber ENT and remitting the applicable booking fee. This applies whether or not the original booking resulted in a completed event.

Opportunities (Event Requests)

Submitting an event request does not guarantee a match. Only the Opportunity Partner's confirmation of a proposed match, followed by receipt of the booking fee, constitutes a confirmed booking. Skyyber ENT reserves the right to decline any event request.

Portal and Submission Use

The Opportunity Partner may not use the event request process to extract DJ roster information, contact DJs outside of a confirmed and paid booking, or otherwise interfere with the operation of the Skyyber DJ Portal. Misuse of released DJ contact information outside the terms of a confirmed booking may result in the applicable booking fee being owed regardless of whether a formal booking was completed.

Liability Limitation

The Skyyber DJ Portal and related services are provided "as-is," without warranty of uninterrupted or error-free operation. Skyyber ENT is not liable for delays, technical issues, or unavailability of the portal, and is not liable for the conduct, performance, or reliability of any DJ introduced through the platform once contact information has been released.

Notifications

We contact you by email at the address you give on your event request: to confirm we received it, and to send your proposed DJ match and rate.

It remains your responsibility to check your email and respond to your proposed match. A missed email is not a reason a DJ will be held open for you.

Acceptable use

Do not use the portal to:

• Submit false or misleading event requests
• Attempt to reach parts of the system you are not authorised to see

Your content

You keep ownership of the information you submit about your event. By submitting it you allow Skyyber Entertainment to share the event details with DJs considering the booking, so they can decide whether to take it.

Ending access

You can ask us to withdraw an event request or remove your information at any time by emailing skyyberent@gmail.com.

We may decline or close a request that breaches these terms. We will keep records of past requests and bookings as a business record.

No warranty

The portal is provided as-is. We work to keep it available and accurate, but we do not warrant that it will be uninterrupted or error-free. To the extent permitted by law, Skyyber Entertainment LLC is not liable for indirect or consequential losses arising from use of the portal.

Changes

We may update these terms. The date at the top of this page shows when they last changed, and we will tell you directly about any material change.
